BASIS OF SALE

• Price is valid for 30 calendar days from date of quoting.

• Your order is not confirmed nor fully booked until your booking fee has been paid.

• By paying a booking fee to secure your booking, you are confirming your acceptance of the Terms and Conditions and details set out on the Order Confirmation.

• No contract is made with you until we have received your booking fee. Once your booking fee has been received you are in a legally binding contract with Italian Cakes By Bee.

THE PRODUCTS

​

I warrant that on collection the Cakes and custom made baked products shall conform to their description as set out in the Order Confirmation, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK. Italian Cakes by Bee will not be held responsible for customer disappointment of the design or the interpretation of the cake as long as it is made in line with the customer’s pre-agreed requirements set out in the order confirmation and will face no consequent liability. It is the customer’s responsibility to ensure all details within the order confirmation and sketch are correct and meet their exact requirements.

The warranty does not apply to any defect in the cakes and baked products arising from wilful damage, accident, negligence by you or any third party, use of the cake in a way we do not recommend, failure to follow our instructions or any alterations you carry out.

 

Italian Cakes by Bee cannot guarantee an exact replica of any cake although all efforts will be made to match the required design. Where colour swatches are provided I will do our best to match as close as we deem possible. Exact colour matches are not guaranteed.  If you have provided a photo as a reference, you understand there may be some variation from the original. 

 

​While I always aim to incorporate your design preferences, I reserve the right to make adjustments to the final cake design where necessary.  I may modify certain elements—such as colour tones, decoration placement, or finer details—to ensure the best possible finish. These decisions are made with the overall aesthetics and structural integrity of the cake in mind.

 

Any samples, drawings, or descriptions issued and any descriptions or illustrations contained on this website are issued solely to provide you with an approximate idea of the cakes they describe and remain the property of Italian Cakes by Bee.

From time to time certain materials may become obsolete. I reserve the right to replace items with component parts of equal or better quality without consultation.

 

If your cake contains figures made from sugar paste, whilst sometimes edible, I do not advise that they be eaten, due to the possible presence of dowels for reinforcement.

 

Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption.

 

All my products are fresh and contain no additives or preservatives and it is my right to assume consumption on the day requested. Cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat, in the box provided. They should not be refrigerated unless advised otherwise.

 

Italian Cakes by Bee and the customer expressly agree that the cakes and all goods purchased from Italian Cakes by Bee remain the property of Italian Cakes by Bee until paid for in full.

 

You agree that images of the cake may be shown on social media or on Italian Cakes by Bee's website.  These images are the property of Italian Cakes by Bee but I will never post a picture before the event date on your order form.  Please advise in writing if you'd prefer any names or images of people which may be displayed on the cake to be made unrecognisable for the photo.

ALLERGIES

​

While I take all precautions to avoid cross contamination, I work in a kitchen where nuts, gluten, egg, milk and other allergens are present, so unfortunately I'm unable to accommodate allergen-free food requests.

​

PAYMENTS

​

​Once you place an order by email, I will issue an invoice. A 50% deposit is payable at the time of booking, the remaining is due on the day specified in the invoice.

 

If payment is not received by the date specified this shall be constituted as breach of contract by the client. Italian Cakes by Bee reserve the right to hold the order until payment is made in full. When payment is late we accept no responsibility should we be unable to purchase the required stock or equipment to make the cake as laid out in the order confirmation.

In these circumstances the cake will be made as close to the order confirmation as possible with no redress or liability on Italian Cakes by Bee.

COLLECTION

​

All orders are to be collected from Italian Cakes by Bee (based in Ascot, Berkshire). We will pre-arrange a time slot for you to collect your order, as I operate out of a private residence and do not have set opening times.

To allow for minor delays such as traffic, a 15-minute grace period is applied either side of the agreed time. Outside of this window, availability cannot be guaranteed.

Italian Cakes by Bee accepts no responsibility for any damage sustained to the cake once it has left the premises.

​

All cakes are the responsibility of the customer once they are collected.  Italian Cakes by Bee is not responsible for any damages to the cake which occur during transportation, set-up or any time thereafter.

​

I will provide instructions to carry, transport, and store the cakes/baked goods on collection.

​

Cakes can be damaged if not handled properly. Italian Cakes by Bee accepts no responsibility for any damage sustained to the cake once it has left the premises.

​

Italian Cakes by Bee accepts no responsibility for any inconvenience, delay, or loss incurred as a result of a customer failing to arrive at the agreed collection time.

This includes, but is not limited to, failure to have the cake in time for an event or celebration. It is the customer’s responsibility to arrive within the arranged timeframe.

​

If collection does not take place as scheduled and alternative arrangements cannot be made, the order may be forfeited without refund.

 ​

CANCELLATIONS

​

If your order is cancelled more than 14 days before the date I will only retain the booking fee.

If you cancel less than 14 days before the date of collection, the full invoice amount is due.

Booking fees are non-refundable.

​

ALTERATIONS

​

I will do my best to accommodate changes in the order or the collection date, although I cannot guarantee I'm always able to do so.

​

When changes are agreed, I will issue a new invoice detailing the order update.

​

In the unlikely event an order is cancelled by Italian Cakes by Bee, I will refund any sums you have paid. 

​

Italian Cakes by Bee reserves the right to cancel, vary or suspend the operation of the contract if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies or any other event outside the control of Italian Cakes by Bee, and Italian Cakes by Bee shall not be liable for any breach of contract resulting from such an event.

 

Italian Cakes by Bee’s liability (both in contract and tort) in respect of defects in goods or services shall be limited to the issue of a credit note in respect thereof or granting a refund or other such compensatory measures as Italian Cakes by Bee, at its discretion, considers appropriate in the circumstances and shall be limited to the value of the goods or services giving rise to the claim.

 

Italian Cakes by Bee shall not under any circumstances be liable for the customer in respect of indirect consequential loss or damage or loss of profits, provided always that these conditions do not exclude or restrict Italian Cakes by Bee’s statutory liability for death or personal injury arising from any negligence on Italian Cakes by Bee’s part or liability imposed by statutory implied terms in Consumer Contracts.

COMPLAINTS

​

If you're unsatisfied with your order, please reach out to me first so we can resolve any issues amicably.

​

If the complain is in regards to the quality of the products, please return any remaining samples of the cakes/products to me as soon as possible so I can inspect them.

 

I kindly ask not to post any negative feedback online before I have the opportunity to address any issues and rectify them if possible.
